Logistics Agency, ADR homepage
- It is the goal of this Center for all parties to be
satisfied at contract completion. Consequently, this Center is encouraging the
use of all forms of ADR to resolve differences of view that may occur under
the contract, whether the differences involve disputes of contract terms,
issues of administration, or merely points of inquiry. The use of any form of
ADR is voluntary for all parties. Any costs associated with the use of ADR
will be agreed to by both parties and with no increase in contract price,
unless agreed to otherwise.

- The Center, or CPRC, was created to help USDA better
handle conflict -- workplace conflict, conflict with farmers or ranchers, even
conflict with other agencies.

Department of the Air Force, ADR
- The Air Force ADR Program is the exemplar program in the
federal government, having received numerous awards for its efforts to bring
resolution to costly and time-consuming disputes.

- The Office of Dispute Resolution
is responsible for operating a program to increase the understanding and use
of Alternative Dispute Resolution (ADR) throughout the Department and with its
contractors.

- The BLM (people, work force, organization, and culture)
will value resolving issues and disputes through alternative dispute
resolution philosophies and processes (alternative dispute resolution) rather
than through confrontation, appeals or litigation.

Department of Justice, Office of
Dispute Resolution
- The Office of Dispute Resolution coordinates the use of
Alternative Dispute Resolution (ADR) for the Department of Justice. The office
is responsible for ADR policy matters, ADR training, assisting lawyers in
selecting the right cases for dispute resolution, and finding appropriate
neutrals to serve as mediators, arbitrators, and neutral evaluators. The
office also coordinates the Interagency ADR Working Group, an organization
that promotes the use of ADR throughout federal executive branch agencies,
which was created by the President and is chaired by the Attorney General.

- Alternative Dispute Resolution (ADR) refers
to any procedure, agreed to by the parties of a dispute, in which they call
upon the services of a neutral party to assist them in reaching agreement and
thus avoid litigation: assisted negotiation, as opposed to unassisted
negotiation or adjudication. Types of ADR include arbitration, mediation,
negotiated rulemaking, neutral factfinding, and minitrials. With one exception
(binding arbitration) the goal of ADR is to provide a forum for the parties
themselves to work towards a voluntary, consensual agreement, as opposed to
having a judge or other authority decide the case.
- In addition to serving as a potential means
of avoiding the expense, delay, and uncertainty associated with traditional
litigation, ADR also is intended as a vehicle for improving communication
between the parties. ADR provides a forum for creative solutions to disputes
that better meet the needs of the parties.

established the DON ADR Program Office with the following missions:
- Coordinate ADR policy and
initiatives;
- Assist activities in
securing or creating cost effective ADR techniques or local programs;
- Promote the use of ADR, and
provide training in negotiation and ADR methods;
- Serve as legal counsel for
in-house neutrals used on ADR matters; and,
- For matters that do not use
in-house neutrals, the program assists DON attorneys and other
representatives concerning issues in controversy that are amenable to
using ADR.
- The ADR Office also serves as
the point of contact for questions regarding the use of ADR. The Assistant
General Counsel (ADR) serves as the “Dispute Resolution Specialist” for the
DON, as required by the Administrative Dispute Resolution Act of 1996.
Members of the office represent the DON’s interests on a variety of DoD and
interagency working groups that promote the use of ADR within the Federal
Government.

- VA Directive
5978, Alternative Dispute Resolution (ADR), February 23, 2000, states that,
“It is the policy of VA to encourage its employees to use mediation to
help resolve workplace conflicts as early as feasible, to the maximum extent
practicable, in an appropriate and cost-effective manner, and at the lowest
organizational level..... Collect and analyze information in a standardized
fashion to enable ADR programs to be monitored and assessed, in order to
measure resource savings, timeliness and user satisfaction.”
